Terms of Service

Welcome to the Tomirro application ("Tomirro" or "the Product"), provided by Anhui Shuzhi Huyu Technology Co., Ltd. ("we" or "our"). By registering, logging in, or using the Product and related services (collectively, "the Services"), you acknowledge that you have read, understood, and accepted all terms of this Agreement. If you do not agree to any provision of this Agreement, please stop using the Product immediately.

01Service Description

Tomirro is a smart wardrobe management application that helps you digitize, organize, and manage your wardrobe. The Product currently includes:

  • Daily Recommendations: Based on real-time weather information at your location, we recommend suitable items from your wardrobe for the day, along with a daily weather greeting.
  • Garment Entry: Import garment photos from your phone's photo library or capture them in real time using the camera. Our AI system analyzes your garment photos, extracts textual descriptions (such as category, color, material, and other attributes), and then generates standardized garment display images based on those descriptions, presenting your clothing in a uniform and aesthetically pleasing manner in your digital wardrobe.
  • Wardrobe Management: View, organize, and manage your digital wardrobe.

We may add, modify, or discontinue certain features of the Services at any time.

02Eligibility

You must be at least 13 years of age to use the Services. If you are under 18, you must use the Services with the permission of a parent or legal guardian, and your parent or guardian must read and agree to this Agreement.

By using the Services, you represent and warrant that you meet the eligibility requirements set forth in this section.

03Account Registration & Login

Use of the Services requires logging in with your Apple ID ("Sign in with Apple").

The Services are currently in an invitation-only beta phase. You must have a valid invitation code to activate and use the Services. Invitation codes are issued by Tomirro, are single-use, and non-transferable. We reserve the right to adjust or discontinue the invitation code mechanism at any time.

You agree to:

  • Ensure that the Apple ID used for login is lawfully owned by you;
  • Not buy, sell, publicly share, or misuse invitation codes in any way;
  • Be responsible for all activities that occur under your account;
  • Notify us immediately if you discover any unauthorized use of your account.

You may not transfer your account to another person. We reserve the right to suspend or terminate accounts that violate this Agreement.

04Device Permissions

The Services require access to the following features on your device:

  • Photo Library Access: For importing garment photos.
  • Camera Access: For capturing garment photos.
  • Location Information: For obtaining weather information to provide daily recommendations.

You may grant or revoke these permissions at any time through your device settings. However, revoking certain permissions may prevent the corresponding features from functioning properly. We only access your location data when weather information is needed and do not continuously track your location.

05User Content & AI-Generated Content

5.1 Your Content

"User Content" refers to all photos, images, and other materials you submit to the Services, including garment photos imported from your photo library and photos captured via the camera.

You retain ownership of your User Content. By submitting User Content to the Services, you grant Tomirro a worldwide, non-exclusive, royalty-free license to use, store, process, and analyze your User Content, solely for the purpose of providing and improving the Services.

This license terminates when you delete User Content from the Services or your account is terminated, except for copies retained for legal compliance or reasonable business needs (such as backups during the normal deletion process).

5.2 AI Processing & Generated Images

When you submit garment photos, our AI system performs the following processing:

  • Image Analysis: Analyzes your photos to detect and identify garments;
  • Text Description Extraction: Converts visual characteristics of garments into textual descriptions (including category, color, style, material, and other attributes);
  • Image Generation: Generates standardized garment display images ("Generated Images") based on the above textual descriptions through AI.

Generated Images are independently created by Tomirro's AI system, and their intellectual property rights belong to Tomirro. During the term of your account, we grant you a free, non-exclusive, non-transferable license to view and use the Generated Images within the Services. You may not use the Generated Images for any commercial purpose outside of the Services without Tomirro's prior written consent.

You acknowledge and agree that:

  • Generated Images are independently created by AI based on garment description information and are not direct edits or crops of your original photos;
  • Generated Images may differ visually from your actual garments, and AI-generated results are not guaranteed to be completely accurate;
  • You may delete any Generated Images and their associated garment information from your wardrobe at any time;
  • Your license to use the Generated Images terminates upon account termination.

5.3 How We Use Your Photos

We aim to be transparent about how garment photos are processed:

  • Your photos are uploaded to our servers for AI analysis to extract garment descriptions and generate display images. Your data may be stored and processed on servers in China (Alibaba Cloud) and the United States (AWS); see Section 9 for details.
  • After AI analysis, your original photos will continue to be retained on our servers for the following purposes: (1) to associate with your wardrobe data so you can view them at any time; (2) to analyze anonymized usage patterns to optimize service features and product experience.
  • We will not use your photos to train general AI models for the benefit of other users or third parties.
  • We will not sell your photos.
  • We will not use your photos for facial recognition or identity verification.
  • We will not share your photos with third parties, except for service providers who assist us in operating the Services (such as cloud hosting and AI processing providers), who are contractually bound to protect and use your data only for the specific purposes we designate.
  • When you delete a garment item or close your account, we will delete the corresponding original photos from our servers within a reasonable timeframe.

5.4 Content Restrictions

You agree not to submit User Content that:

  • You do not have the right to share;
  • Is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable;
  • Contains viruses or malicious code;
  • Infringes any third party's intellectual property or privacy rights.

We reserve the right to remove any User Content that violates this Agreement.

06Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose;
  • Attempt to gain unauthorized access to the Services or their systems;
  • Interfere with or disrupt the normal operation of the Services or servers;
  • Reverse engineer, decompile, or disassemble any part of the Services;
  • Use automated means (bots, crawlers, etc.) to access the Services;
  • Impersonate any other person or entity;
  • Use the Services to collect information about other users;
  • Copy, modify, or distribute the Services or their content without authorization;
  • Attempt to circumvent any security or access control measures of the Services.

We reserve the right to terminate your access for violation of the above prohibited conduct.

07Intellectual Property

All text, graphics, designs, software, trademarks, logos, and other content provided through the Services (excluding User Content) are owned by or licensed to Tomirro and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works based on any part of the Services without our prior written consent.

The Tomirro name, logo, and all related marks are trademarks of Tomirro. You may not use these trademarks without our prior written permission.

08Subscriptions & Payments

The Services are currently offered free of charge. We may introduce paid features or subscription plans in the future. At that time, pricing and billing terms will be presented to you before purchase.

Any purchases made through the Apple App Store are subject to Apple's terms and refund policies.

09Data Storage & Cross-Border Transfer

Your User Content (including garment photos), Generated Images, and account data may be transferred to, stored, and processed in countries and regions outside your country of residence, including:

  • China: For cloud storage and content delivery (Alibaba Cloud OSS/CDN)
  • United States: For database and application infrastructure (AWS RDS, ElastiCache, ECS)

Data protection laws in these countries and regions may differ from those in your location. By using the Services, you consent to the transfer and processing of your data in these regions. We will implement reasonable technical and administrative measures to protect your data security and ensure your information is protected in accordance with this Agreement and our Privacy Policy.

10Third-Party Services

The Services may integrate with or contain links or interfaces to third-party services (such as weather data providers and AI processing providers). We do not control third-party services and are not responsible for their content, privacy practices, or availability. Your use of third-party services is at your own risk and subject to their respective terms.

11Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Services will operate without interruption, error-free, or securely;
  • AI-based garment recognition, attribute extraction, or image generation will be completely accurate;
  • AI-generated garment images will be identical to your actual garments;
  • Weather data or outfit recommendations will be accurate or suitable for your needs;
  • Defects will be corrected.

Your use of the Services is at your sole risk.

12Limitation of Liability

To the maximum extent permitted by law, Tomirro and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services, including but not limited to data loss, loss of profits, or personal injury.

In no event shall Tomirro's total liability to you exceed the greater of: (A) the amount you paid to Tomirro in the twelve (12) months preceding the claim, or (B) one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; therefore, some of the above limitations may not apply to you.

13Indemnification

You agree to defend, indemnify, and hold harmless Tomirro and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Services;
  • Your User Content;
  • Your breach of this Agreement;
  • Your infringement of any third-party rights.

14Account Termination

Either party may terminate this Agreement at any time. You may delete your account through the Settings feature in the Services, or contact us at privacy@tomirro.com.

If we believe you have violated this Agreement, we reserve the right to suspend or terminate your account without prior notice.

Upon account termination:

  • Your right to use the Services terminates immediately;
  • We will delete your User Content, Generated Images, and account data within a reasonable timeframe, unless retention is required by law;
  • Sections 7, 11, 12, 13, 15, and 16 of this Agreement shall survive termination.

15Dispute Resolution

15.1 Informal Resolution

Before initiating any formal proceedings, you agree to first contact us at privacy@tomirro.com and attempt to resolve the dispute informally for at least thirty (30) days.

15.2 Binding Arbitration

If the dispute cannot be resolved informally, you and Tomirro agree that any dispute arising out of or relating to this Agreement or the Services shall be submitted to binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in English and held in San Francisco, California, United States.

15.3 Class Action Waiver

You and Tomirro agree that disputes shall only be resolved on an individual basis. You waive the right to participate in class actions, class arbitrations, or any other representative proceedings.

15.4 Exceptions

Either party may seek injunctive or equitable relief from a court of competent jurisdiction to protect intellectual property rights. You may also bring eligible claims in small claims court.

16Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

17Changes to This Agreement

We may update this Agreement from time to time. When we make significant changes, we will notify you through the Services or by other means. Your continued use of the Services after changes take effect constitutes your acceptance of the modified Agreement. If you do not agree to the modified Agreement, you should stop using the Services.

18General Provisions

  • Entire Agreement: This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Tomirro regarding the Services.
  • Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
  • Waiver: Our failure to enforce any provision of this Agreement shall not constitute a waiver of that provision.
  • Assignment: You may not assign this Agreement without our prior written consent. We may assign this Agreement without restriction.
  • No Agency: This Agreement does not create any agency, partnership, or joint venture relationship between you and Tomirro.
